Role/Job Description The Corporate Counsel, Employment and Litigation attorney will provide legal advice and support of employment, litigation and contracts needs to one or more business units in Europe, (primarily Spain, Portugal, Italy and Greece, potentially including other jurisdictions). The candidate will be responsible for providing legal counsel to Sales, Marketing, Market Access, Medical Affairs, Compliance, Regulatory and Procurement. The candidate will advise and manage employment and litigation, among other issues in the region as they arise. The candidate will provide counselling on applicable laws and regulations impacting the commercialization of our biosimilar portfolio, including, but not limited to EMA advertising law and related guidance, fraud and abuse issues, anti-kickback and bribery issues, federal and state transparency and privacy laws, antitrust and regulatory policy. The Corporate Counsel, Employment and Litigation attorney will collaborate with other attorneys in the International Legal Department. The Corporate Counsel, Employment and Litigation attorney will be a legal advisor and business partner to the European business. Responsibilities : · Provide corporate, employment, litigation, and contract advice to the European commercial operations of the Biocon Biologics business unit, including working on product launches. · Draft, review and revise a broad range of commercial agreements associated with the European business, including agreements with healthcare professionals and providers, vendors, licensors, consultants, and speakers as well as master services agreements, statements of work, sales, supply and distribution and other types of agreements supporting the commercial business. · Work with Commercial Compliance providing counsel to sales, marketing, regulatory and medical teams regarding employment, litigation, promotional materials and regulations, fraud and abuse laws, and business and contract issues in our day-to-day operations, including all related strategy and tactics and related training on such issues as disease awareness and marketing campaigns, patient support programs, specialty pharmacy interactions, digital tools, patient education and Market Access interactions. In advising on these issues, the attorney will consider relevant risks and analysis under applicable laws and regulations governing the pharmaceutical industry. · Will work on cross functional teams and with other attorneys in the International Legal Department to provide comprehensive advice to clients. · Other tasks/assignments as required. Background & Experience Required 10+ years of relevant legal experience in the biotechnology and/or branded pharmaceutical industries. 8+ years in a legal department practicing commercial, litigation and employment. Experience engaging and supporting business leads as contact legal counsel. Extensive knowledge of the biotechnology/pharmaceutical industry in EU, including legal requirements and contractual agreements, selling products in these markets. Extensive knowledge of the EU healthcare, regulatory and commercial Litigation/employment law. Ability to work effectively in a global work environment.
